What the CLOUD Act is, and why hosting is not enough
It is a 2018 US law that allows United States authorities to demand access to data held by a US-law company and its subsidiaries, wherever the servers are hosted.
A foreign vendor hosting in France therefore remains subject to the CLOUD Act. As soon as one part of your recruiting goes through an American player, an ATS or an AI like GPT or Gemini, your CVs are exposed. Without your candidates, or you, being told.
The two questions to ask your current ATS: "Who can legally access my candidate data? And which model does my AI run on?"

Can the CLOUD Act apply if my data is hosted in France?
Yes, if the vendor is a US-law company or one of its subsidiaries: the CLOUD Act applies wherever the servers are hosted. That is not our case. JobAffinity is a French company, with French capital, hosted in France at Scaleway.
Do you have SecNumCloud?
The SecNumCloud qualification is in progress on the hosting provider side; it has not been obtained to date. What is in place: data centres in France, APSAD R13 certified and HDS qualified, on the same infrastructure as the DINUM and several French ministries.

On our own servers, at a French hosting provider. JAI is an open-source AI: the data you entrust to it is processed in France, it goes neither to America nor to Asia. Your IT department can verify it.
Is my data used to train your AI?
No, never. Your CVs remain your CVs: they are used neither to train nor to improve a model, with us or anyone else.
What about the AI Act?
Recruitment is classified as high risk by the AI Act, applicable on 2 December 2027: effective human oversight, documentation, traceability. What binds you today is Article 22 of the GDPR. JobAffinity is designed for both.
Who oversees data protection?
A data protection officer, registered with the CNIL, oversees governance. Retention periods, consents and deletions are configurable and traced in the tool.
